Widening Project
Public Involvement Meetings scheduled by the Alabama
Department of Transportation on the proposed I-10
Mobile River bridge and I-10 Bayway widening project.
The meeting dates and locations are:
Tuesday August 31
5:00 to 7:00 p.m.

The meetings will be an open house "walk through"
format, with exhibits of the proposed routes on
display.
Representatives from ALDOT and contracted consultants
will be present to answer questions and discuss the
project.
Comment sheets will be provided.
Please share information about this meeting with
your colleagues and make every effort to
attend.
It's critical that ALDOT hear from citizens and
organizations in both Mobile and Baldwin
Counties about the proposed project.

New Federal Rules for
Stormwater Runoff from Construction Sites- ADEM
Workshop August 26th
EPA recently
finalized new stormwater requirements that will impact
nearly every construction and development project in
the United States. These “Construction and Development
Effluent Limitations Guidelines” (C&D ELG) impose an
enforceable numeric limit on stormwater discharges
from sites disturbing 10 acres or more at any one
time, require monitoring to ensure compliance with the
numeric limit, and require nearly all construction
sites to implement a range of prescriptive erosion and
sediment controls and pollution prevention measures.
The new ELG requirements will directly apply to
individual construction sites via incorporation in
individual and general National Pollutant
Discharges Elimination System (NPDES) construction
stormwater permits. EPA will include the ELG
requirements in its federal Construction General
Permit when it is reauthorized by July 2011.
States are required by EPA to include the new ELG
requirements into their permits the next time they
are renewed (or earlier if the states so
choose).
Penalties for violating these new
federal C&D ELG requirements may reach $37,500 per day

OSHA Issues
New Rule Regulating Cranes
Significant Changes and New
Requirements

2010
The U.S.
Department of Labor's Occupational Safety and
Health Administration (OSHA) issued on July 28,
2010, a new rule addressing the use of cranes
and derricks in construction. Approximately
267,000 construction, crane rental and crane
certification establishments employing about
4.8 million workers will be affected by the final
rule.
The previous rule, which
dated back to 1971, was based on
40-year-old standards. The new rule is designed to
prevent the leading causes of fatalities,
including electrocution, crushed-by/struck-by
hazards during assembly/disassembly, collapse and
overturn. It also sets requirements for
ground conditions and crane operator assessment.
In addition, the rule addresses tower crane
hazards, addresses the use of synthetic slings for
assembly/disassembly work, and clarifies the scope
of the regulation by providing both a functional
description and a list of examples for the
equipment that is covered.
The
new rule will take effect on Nov. 8, 2010.

National AGC Persuades Corps of
Engineers
to Withdraw PLA Requirement
Solicitations requiring bidders on certain U.S. Army
Corps of Engineers (USACE) construction projects
to submit an executed project labor agreement
(PLA) prompted AGC to write and call agency
officials expressing strong concern. On August
18, the agency called AGC to announce that it was
withdrawing the PLA requirement and to thank AGC for
educating them on the issue.
On August 12, National AGC sent a
letter
to the USACE's Mobile District demanding information
about the agency's justification for including a PLA
mandate in a solicitation for the construction of an
Air Force Technical Applications Center at Patrick
Air Force Base in Florida. The letter questioned
how it determined that the conditions listed in
President Obama's executive
order on PLAs were present. The
requirement, along with similar mandates by other
contracting agencies and information about pressure
from higher in the Administration, also prompted
AGC to send a
letter
calling on President Obama to protect contracting
officers from such political pressure, and to send an
"unmistakable and public" message that political
appointees should not cross the line between politics
and procurement.

"Worlds of Opportunity" Career Expo
September
29th-30th
The
Construction
Industry will be featured as part of the Career
Expo which will be held September 29th and 30th at the
Greater Gulf States Fairgrounds in Mobile.
Over 6000 eighth grade students
from eight southwest Alabama counties will attend.
The expo, a project of Southwest Alabama Workforce
Development Council (SAWDC), will be a fun,
educational, hands-on opportunity for students to
become familiar with a broad overview of jobs
available in our area.
